§ 15-3. Mufflers, smelly or noisy vehicles.

  • (a)

    It shall be unlawful for any person to cause the exhaust of any motorcycle, motor-driven cycle or motor vehicle to be discharged into the open air except through a muffler or other device which effectively prevents loud or explosive noises therefor.

    (b)

    It shall be unlawful for any person to operate a motorcycle, motor-driven cycle or motor vehicle on public or private property where the operation of such motorcycle, motor-driven cycle or motor vehicle creates a public or private nuisance or creates any loud, unnecessary, or unusual noise or any noise which either annoys, disturbs, injures, or endangers the comfort, repose, health, peace or safety of any other person except the sounding of a horn or signaling device as a danger warning.

    (c)

    It shall be unlawful for any person to knowingly and intentionally permit anyone upon his premises to violate subsections (a) or (b); provided, however that this shall not apply to the owner of any bona fide garage or mechanic shop upon which any such vehicle is located for repairs or service.

    (d)

    As used herein the following words have the meanings hereinafter ascribed to them:

    (1)

    Motorcycle means every motor vehicle, including a motor skooter, having a seat or saddle for the use of the rider and designed to travel on not more than three (3) wheels in contact with the ground but excluding a farm tractor.

    (2)

    Motor-driven cycle, means every motorcycle, including every motor scooter, with a motor which produces not to exceed five (5) horsepower and every bicycle with a motor attached thereto.

    (3)

    Motor vehicle means every vehicle which is self propelled and every vehicle which is propelled by electric power.

    (e)

    Any person who violates any of the provisions of this section shall be fined an amount not to exceed one hundred dollars ($100.00), or imprisoned in the parish jail for a period of time not to exceed thirty (30) days, or both fined and imprisoned at the discretion of the court.
