§ 15-4. Speed limits.

  • (a)

    Parishwide Speed Limits.

    (1)

    The council establishes and fixes the maximum speed limit on any parish street and parish lateral road at fifteen (15) miles per hour for automobiles, trucks and other motor vehicles that does not have a specific ordinance establishing a specific speed limit.

    (2)

    Any person caught violating the provisions of this subsection shall be deemed guilty of a misdemeanor and upon conviction by a court of competent jurisdiction shall be fined not less than twenty-five dollars ($25.00) or imprisoned not more than ten (10) days for each offense at the discretion of the courts.

    (b)

    Specific Speed Limits.

    There is hereby established a maximum speed limit for vehicular traffic consisting of motorcycles, motor-driven cycles, or motor vehicles, upon the various streets and parish roadways within the parish as follows:

    (1)

    a.

    Sunrise Subdivision, Sunrise, Louisiana - Orange Street and Banks Street: ten (10) miles per hour.

    b.

    Any person violating the provisions of this subsection (1) shall be guilty of a misdemeanor and upon conviction by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned in the parish prison for not more than ten (10) days, or both.

    (2)

    a.

    A speed limit of fifteen (15) miles per hour is hereby fixed for all motorized vehicular traffic on Star Place Drive.

    b.

    All persons are prohibited from operating any motorized vehicles on Star Place Drive in excess of fifteen (15) miles per hour.

    c.

    Any person found to have violated the provisions of this subsection (2) by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the parish jail, or both fined and imprisoned at the discretion of the court.

    d.

    As used in this subsection (2), the following words have the meanings hereinafter ascribed to them:

    1.

    Motor vehicle means any vehicle which is propelled or drawn on land by a motor-gasoline, diesel, electric, steam, or otherwise—including but not limited to passenger cars, trucks, truck-trailers, semitrailers, campers, go-carts, motorcycles, motor scooters, amphibious craft on land, dune buggies, racing vehicles, buses, motor homes, motorized campers, tractors, motor-driven cycles, and the like.

    2.

    Person means any individual, association, partnership or corporation, and includes any officer, employee, agent or representative of such person.

    (3)

    a.

    The speed limit of vehicular traffic on a section of Plaquemines Parish Highway No. 11 from its northerly intersection with Louisiana State Highway No. 23 to its southerly intersection with Louisiana State Highway No. 23 at Jesuit Bend is hereby fixed at a maximum of thirty-five (35) miles per hour, with appropriate speed limit signs posted.

    b.

    Any person violating the provision of this subsection (3) will be guilty of a misdemeanor and upon conviction thereof by a court of competent jurisdiction shall be fined not more than fifty dollars ($50.00) or imprisoned for not more than thirty (30) days or both fined and imprisoned at the discretion of the court.

    (4)

    a.

    A speed limit of fifteen (15) miles per hour is hereby fixed for all motorized vehicular traffic on Good News Avenue, Belle Chasse, Louisiana.

    b.

    Any person violating the provisions of this subsection (4) by a court of competent jurisdiction shall be fined not more than fifty dollars ($50.00) or imprisoned for not more than fifteen (15) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (5)

    a.

    The speed limit for trucks and other equipment in excess of three-quarter-ton capacity traveling upon the public levees, levee rights-of-way and off-highway areas is hereby fixed at fifteen (15) miles per hour.

    b.

    Any person violating the provisions of this subsection (5) shall be guilty of a misdemeanor and upon conviction by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or be imprisoned for not more than thirty (30) days or both at the discretion of the court.

    (6)

    a.

    A speed limit of fifteen (15) miles per hour is hereby fixed for all motorized vehicular traffic on Forest Drive, Jesuit Bend.

    b.

    Any person found violating the provisions of this subsection (6) by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (7)

    a.

    A speed limit of fifteen (15) miles per hour is hereby fixed for all motorized vehicular traffic on Victoria Drive, Pasturelle Plantation, Jesuit Bend.

    b.

    Any person found violating the provisions of this subsection (7) by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (8)

    A speed limit of fifteen (15) miles per hour is hereby fixed for all motorized vehicular traffic on Carol Lane, Nairn.

    (9)

    a.

    A speed limit of fifteen (15) miles per hour is hereby fixed for all motorized vehicular traffic on Sara Victoria Drive, Pasturelle Plantation, Jesuit Bend, Louisiana.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (10)

    A speed limit of forty-five (45) miles per hour is hereby fixed for all motorized vehicular traffic on Tidewater Road, Venice, Louisiana, from its beginning to its end, except in the curves of the road wherein the speed limit shall be thirty (30) miles per hour.

    (11)

    a.

    A speed limit of twenty-five (25) miles per hour from the entrance of Walker Road to the end of East Bayou Road is hereby fixed for all motorized vehicular traffic on Walker Road and East Bayou Road, Belle Chasse, Louisiana.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (12)

    a.

    The speed limit on Main Street, from Oak Road to F. Edward Hebert Blvd., Belle Chasse, Louisiana, is hereby fixed at thirty-five (35) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (13)

    a.

    The speed limit on English Turn Road, Braithwaite, Louisiana, is hereby set at twenty-five (25) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (14)

    a.

    The speed limit on Highway 11 from the intersection of Highway 23 to West Paula Drive, Port Sulphur, Louisiana, is hereby fixed at thirty-five (35) miles per hour for all motorized vehicular traffic

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (15)

    a.

    The speed limit on Main Street from Avenue G to Oak Street, Belle Chasse, Louisiana, is hereby set at fifteen (15) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (16)

    a.

    A speed limit of thirty-five (35) miles per hour is hereby established for all vehicular traffic on Barriere Road, Belle Chasse, Louisiana.

    b.

    Any person found violating of the provisions of this subsection shall be fined not more than one hundred dollars ($100.00).

    (17)

    a.

    The speed limit on Suzie Bayou Road, beginning on Lake Hermitage Road three hundred (300) feet before Suzie Bayou Road, Lake Hermitage, Louisiana, is hereby set at fifteen (15) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (18)

    a.

    The speed limit in the Springwood Subdivision, Belle Chasse, Louisiana, is hereby set at fifteen (15) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (19)

    a.

    The speed limit on "R" Street, Belle Chasse, Louisiana, is hereby set at fifteen (15) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (20)

    a.

    The speed limit on Belair Pump Road, Braithwaite, Louisiana, at fifteen (15) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (21)

    a.

    The speed limit on all streets off of Engineers Road, more specifically, North Concord Road, Buras Drive, Eymard Road, WPA Road, Bayou Road, and Jourdan Road, Belle Chasse, Louisiana, is hereby changed from fifteen (15) miles per hour to twenty-five (25) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (22)

    a.

    The speed limit on Highway 11, from its beginning in Homeplace to Olivia Lane in Empire, Louisiana, is hereby changed from thirty-five (35) miles per hour to forty-five (45) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars or imprisoned for not more than thirty (30) days in the parish jail or both fined and imprisoned at the discretion of the court.

    (23)

    a.

    The speed limit on Paul Morgan Road, Boothville, Louisiana, is hereby set at twenty-five (25) miles per hour for all motarized traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars.

    (24)

    a.

    The speed limit on El Dorado Street, Buras, Louisiana, between Highway 11 and Highway 23 is hereby changed to fifteen (15) miles per hour for all motorized vehicular traffic.

    b.

    Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars.
