§ 15-6. Restrictions as place on commerce.

  • (a)

    It shall be unlawful for any person to engage in the unlicensed sale, purchase or transfer of any item of seafood upon the public highways in the parish; provided, however, that this provision of law shall not apply to the sale, purchase or transfer of any item of seafood when both the buyer and the seller is licensed by the parish government to engage in business in the parish, by holding a valid occupational license or permit issued by the parish, a sales tax number issued by the parish, and all other applicable state and local permits required by state and local government to assure the wholesomeness and fitness for consumption of that seafood put into the chain of commerce by sale, purchase or transfer by whatever means effectuated.

    (b)

    It shall be unlawful for any person to knowingly and intentionally permit any individual to sell, purchase or transfer any item of seafood upon his property or the highway rights-of-way upon his property in violation of subsection (a). It is the duty of the licensed seller, purchaser or transferor to inquire and ascertain that his buyer, seller or transferee possesses the occupational licenses and health permits required by state and local government.

    (c)

    As used herein, the following words have the meanings hereinafter ascribed to them:

    (1)

    Public highways or public highway rights-of-way shall be defined as that definition for "highway" found at R.S. 32:1.

    (d)

    Any person who violates any of the provisions of this section shall be fined an amount not to exceed five hundred dollars ($500.00) per incident, or imprisoned in the parish jail for a period of time not to exceed thirty (30) days, or both fined and imprisoned at the discretion of the court. Additionally, any person who violates any of the provisions of this section shall have his occupational license automatically revoked.

    (e)

    Any law enforcement officer is authorized to cite any individual violating the foregoing provisions.
