§ 17.5-51. Parish funding of fairs and festivals.

(a)

All fairs and festivals applying for a donation from the Plaquemines Parish Council pursuant to LA Revised Statute 33:3001, must satisfy the following three (3) requirements to be eligible to receive said donation.

(1)

All fairs and festivals shall be a non-profit 501C entity in good standing with the State of Louisiana and shall submit proof of its status to the parish government at the time for applying for said donation.

(2)

All fairs and festivals must be a 501C entity that has been in existence for at least five (5) years prior to applying for said donation.

(3)

All fairs and festivals shall enter into a cooperative agreement with the parish government setting the guidelines for the operation of said fair or festival.

(b)

All fairs and festivals shall apply for said donation as an attachment to the special events permit at the time of submittal of the permit, but no later than Sixty (60) days prior to the fair and festival commencement date.

(c)

The parish council shall decide, at the offering of the fair and festival special event permit and donation request, the amount of money or donation that the eligible fair and festival is to receive under LA Revised Statute No. 33:3001 at the sole discretion of the parish council. The parish council may donate none, some, or all of its money or donation to any one entity or entities at its own discretion. The parish council may take the following factors under consideration for the distribution of its donation:

(1)

Length of time that the fair and festival has been in existence in Plaquemines Parish.

(2)

Size of the fair and festival based on public attendance.

(3)

Benefit of the fair and festival to Plaquemines Parish.

(4)

Amount of participation of the parish government in said event.

(5)

Location of fair and festival on public or private property.

(6)

Any other factor that the parish council deems relevant to make its consideration.

(d)

In making its consideration as to the amount of the donation to any fair or festival, the parish government shall not discriminate against any fair or festival on the basis of race, sex, age, religion or sexual preference in accordance with Title 7 of the United States Code.
