§ 17-11. Sale of food, merchandise, etc., on public property prohibited; exceptions.

  • (a)

    Sales on public property prohibited. It shall be unlawful for any person to sell merchandise, wares, goods, food, food products, plants, flowers, seafood of any kind, paintings, mirrors, or any artifact or saleable product from any truck, automobile, motor vehicle, mobile unit, cart, stand, table, temporary building, portable or moveable container or display case, whether closed or enclosed, or operating on a permanent, temporary, or seasonal basis upon public rights-of-way such as a street, boulevard, highway, roadway, emergency lane, neutral ground, or shoulder of a road which is used for vehicular traffic or any other public property dedicated for specific use.

    (b)

    Penalties. Any person or persons found to be in violation of this section shall be found guilty of a misdemeanor and shall be sentenced to no more than six (6) months in the Plaquemines Parish Prison and fined not more than five hundred dollars ($500.00), or both. The amount of the fine and length of the jail term shall be at the sole discretion of the district court judge.

    (c)

    Exepmtions.

    (1)

    The provisions of this section shall not apply to any parish-owned property which is under lease and/or under a cooperative agreement allowing the sale of any food, goods or merchandise or any other product listed in subsection 17-11(a) above.

    (2)

    Further, the provisions of this section shall not apply to any individual or business delivering any food, goods or merchandise or any other product listed in subsection (a) above on any parish-owned property.

    (3)

    All Plaquemines Parish Government volunteer fire departments are exempt from this section.
