§ 17-18. Rules and regulations for the use of fireworks.

  • (a)

    No person shall explode or ignite fireworks in Plaquemines Parish except during the following periods of the year.

    (1)

    June 25 through July 5.

    (2)

    December 15 through January 1.

    It shall be unlawful and a violation of the law for any use of fireworks other than during these specified periods of times, unless a special permit is obtained from the parish council through the parish government permit office with proper fire protection.

    (b)

    No minor child under the age of eighteen (18) years old shall explode or ignite fireworks unless under the supervision of an adult.

    (c)

    No person shall ignite or discharge fireworks in a motor vehicle or throw fireworks from a motor vehicle.

    (d)

    No person shall place an ignited article of fireworks in or throw an ignited article of fireworks at a motor vehicle.

    (e)

    Only those fireworks identified as "Class C" common fireworks as defined by Louisiana Revised Statute 51:651.1 ET, SEQ shall be used in the Parish of Plaquemines.

    (f)

    Violations. Any person that does not act in conformity with the above rules and regulations established in subsections (a)—(e) is hereby in violation of this fireworks ordinance and is subject to the penalties contained herein.

    (g)

    Penalty. Whoever violates any subsection of this section shall be fined not more than five hundred ($500.00) dollars, or imprisoned for not more than six (6) months, or both.

    (h)

    Exemptions—Public displays of fireworks. Nothing in this section shall be construed as applying to the use of fireworks for public displays at fairs, festivals, rodeos, high school athletic contests, or any other public event by holders of a permit for public display which has been approved by the state fire marshall or the parish government.

    (i)

    The provisions of this section shall be cumulative of each other and of all other laws in any way affecting the subject matter of this section now in force in this state.
