§ 17-52. Regulation of door-to-door sales; prohibited activities.

  • (a)

    It shall be unlawful for any person, other than persons engaged in promoting a political cause or candidate, or in fundraising sales for charitable or educational purposes, to call upon private residences for the purpose of offering goods or services for sale or for the purpose of soliciting orders for the sale of goods or services unless such person:

    (1)

    Applies for and is granted an Occupational License with the Plaquemines Parish Sheriff's Office (PPSO), at the customary fee charged by said sheriff's office;

    (2)

    Applies for and is granted a peddler's permit with the PPSO, which when issued will consist of a photo ID indicating the name, address and employer of the door-to-door salesperson, and shall be a minimum of three (3) inches by four (4) inches and worn around the neck by way of a lanyard for easy viewing when approached by such person.

    (3)

    Applies to the PPSO, before issuance of the peddler's permit, for a complete criminal background check, to be run by the PPSO at the applicant's expense, which expense shall be reasonable and customary. Said criminal background check must show no felony convictions or misdemeanor convictions involving dishonesty, deceit, or sexual offenses, or crimes of violence as a condition precedent to issuance of the peddler's permit.

    (4)

    A peddler's permit shall be issued for no more than one (1) year, renewable annually, with a new criminal background check every fifth year.

    (5)

    Said peddler's permit may be revoked summarily by the Plaquemines Parish Sheriff's Office upon notification that the permit holder has been convicted of any felony, or any misdemeanor of the type outlined above in subsection (a)(3), or upon the discovery of any misleading information supplied on any application described above.

    (b)

    The time of door-to-door solicitation is hereby limited to take place between the hours of 9:00 a.m. and one (1) hour before sunset. Door-to-door solicitation outside of those times is prohibited.

    (c)

    The PPSO shall maintain a "no solicitation list" wherein a parishioner can register his or her name and address, which shall be provided to the peddler permit applicant. It shall be unlawful for the holder of a peddler's permit to enter upon the premises contained in the no solicitation list, or any residence where there is clearly displayed a "No Solicitation" sign.

    (d)

    Any violation of this article shall be punishable by a fine in the amount of five hundred dollars ($500.00), and a revocation of the peddler's permit.

    (e)

    Any peddler's permit holder or applicant aggrieved by any action of the PPSO in the revocation or failure to issue a peddler's permit shall have a right to a de novo review of the PPSO's actions in the 25th Judicial District Court for the Parish of Plaquemines.
