§ 19-63. Public works projects.

  • (a)

    In the case of routine levee maintenance, setback, enlargement and the like, or in the case of routine drainage canal maintenance, relocation and the like, the permittee shall make such alterations to the bridge including, but not limited to, relocation (partial or total), removal and alterations necessary to accommodate such public work projects. All such work must be completed within the reasonable time frame provided by the parish in a written notice to the permittee so as not to hinder in any manner the proper performance and completion of the public works project.

    (b)

    In the case of a bona fide public emergency declared by the council involving levee and/or drainage canal work, the parish and the council shall have the right to remove, alter or destroy the bridge with parish work forces or contract work forces at the expense of the permittee after having communicated its intentions to the permittee through any means reasonable under the circumstances or without such prior notice if after due diligence the permittee is unable to be located and the bona fide emergency requires immediate action. The permittee shall execute in writing his consent to such action on the part of the parish and the council on the basis of such a bona fide emergency situation prior to the issuance of any permit hereunder which written consent shall be maintained on file by the parish in the permittee's records.
