Article V. DRAINAGE CANALS AND LEVEES—PIPELINES, RAMPS AND FENCES |
§ 19-84. Minimum requirements.
Without in any way limiting the requirements set forth in other sections of this article, the following nonexclusive list of items is set forth as minimum construction requirements:
(a)
Pipelines:
(1)
All pipeline crossings are to be constructed according to the United States Corps of Engineer criteria.
(2)
The applicant for a pipeline crossing shall agree to repair any damages to the levee system which may result from the pipeline crossing.
(3)
The pipeline applicant shall agree to relocate the pipeline crossing at his own expense in the event of upgrading of the levee system.
(4)
The pipeline applicant shall maintain adequate cover on the pipeline at the section of the levee where the pipeline crosses at all times.
(5)
The pipeline applicant shall maintain the grass on the section of the levee used for the pipeline crossing plus ten (10) feet on either side of the pipeline crossing.
(6)
The pipeline applicant shall properly mark the pipeline crossing with warning signs plus the name of the owner of the pipeline and an emergency phone number.
(7)
All pipelines crossing drainage canals shall be placed at least five (5) feet below the minimum elevation required by the parish drainage department for the drainage canal area crossed by the pipeline, and no obstructions shall be placed in the canal so as to hamper the flow of drainage water.
(8)
The pipeline applicant shall furnish the parish council with a performance bond, property bond or a commercial surety bond from a surety company authorized to do and doing business in this State of Louisiana in the following amounts:
a.
Oil field pipe line crossing a levee, drainage canal, parish road or street:
1.
A construction bond in the amount of one hundred thousand dollars ($100,000.00).
2.
A permanent bond in the amount of ten thousand dollars ($10,000.00) to remain in full force and effect as long as the crossing is in existence.
3.
A certificate of insurance naming the parish as a named insured in a comprehensive general liability insurance policy in the amount of one million dollars ($1,000,000.00) to insure against damages to the levee, drainage canal, parish road or street.
b.
Waterline, i.e. siphon, crossing a levee, drainage canal, parish road or street:
1.
A construction bond in the amount of ten thousand dollars ($10,000.00).
2.
A permanent bond in the amount of two thousand dollars ($2,000.00) to remain in full force and effect as long as the crossing is in existence.
3.
A certificate of insurance naming the parish as a named insured in a comprehensive general liability insurance policy in the amount of one million dollars ($1,000,000.00) to insure against damages to the levee, drainage canal, parish road or street.
(b)
Ramps:
(1)
All ramps crossing the parish levees must be constructed according to the United States Corps of Engineers criteria.
(2)
The ramp applicant shall maintain the ramps and levee crown to the existing grade when in use.
(3)
The ramp applicant shall restore the levee crown and slopes to the original condition when the ramps are removed.
(4)
The ramp applicant shall agree to raise the ramp to design grade at their own expense should the section of the levee on which the ramp is located be raised, altered or relocated at any time in the future.
(5)
The ramp applicant shall maintain the grass within ten (10) feet on either side of the ramp.
(6)
The ramp applicant shall ensure that there will be no parking of vehicles and equipment within the levee right-of-way at any time.
(7)
The ramp applicant shall furnish the parish council with a performance bond, property bond or commercial surety bond from a surety company authorized to do and doing business in the State of Louisiana as follows:
a.
A construction bond in the amount of ten thousand dollars ($10,000.00).
b.
A permanent bond in the amount of two thousand dollars ($2,000.00) to remain in full force and effect as long as the ramp is in existence and being used by the applicant.
c.
A certificate of insurance naming the parish as a named insured in a comprehensive general liability insurance policy in the amount of one million dollars ($1,000,000.00) to insure against damages to the levee
