Article VI. STREET IMPROVEMENT LIEN ASSESSMENTS |
§ 19-125. Project costs and funding.
(a)
The parish engineering department shall prepare a report for the parish council detailing the estimated cost of the project including, but not limited to, all improvements including street intersections, engineer's and attorney's fees, and other expenses incidental to the costs of such improvements. The report shall include information showing the amount chargeable to each lot abutting the road or street on which the hard surfacing will be done. The amount shall be computed on a front foot basis by taking the total project cost and dividing same by the total lineal frontage of all immovable property fronting on the road or street. The report shall also include a legal description of each lot sufficient to identify it as well as other information obtained by the engineering department to support the calculations. A copy of the report shall be provided to the parish attorney's office and the finance department together with any findings or changes made by the parish council.
(b)
After presentation of the report and the engineering plans and specifications for the project, the parish council shall determine whether each lot or parcel of immovable property to be assessed will be benefited in an amount not less than the proposed assessment. Any proposed assessment erroneously made or not meeting the described benefit shall be deleted from the report. Following such review, the engineering department shall advertise for bids for construction of the project according to law.
(c)
The parish finance department shall send out statements to the owners of all of the immovable property abutting the project road requesting written notice of any inaccuracies in the assessment within fifteen (15) days from the date of said notice or otherwise to demand payment of their pro rata share of the cost within thirty (30) days of receipt thereof. Notice shall be given as provided in R.S. 33:3689.7, as amended. After making provisions for crediting any payments received, the finance department shall provide the parish council, and a copy to the parish attorney's office, with a list of the names, addresses and other relevant information on each immovable property owner sufficient to provide for the enactment of a special assessment as provided hereinafter. Any payments received by the finance department shall be deposited into the capital construction account for the project.
