§ 20-3. Permit or council approval required.

  • (a)

    It shall be unlawful for any person, firm or corporation to subdivide or resubdivide a lot, tract or parcel of land into two (2) or more lots, plots, parcels or building sites for the purpose of alienation or of building development or improvement, either immediate or future, unless such person, firm or corporation has first obtained (1) a valid and existing parish permit therefor, issued by the parish council pursuant to an Ordinance passed by the parish council giving final approval of a plan of subdivision or resubdivision under the terms and conditions of this chapter, or (2) certification issued by the department of planning, permits and zoning that the proposed transaction is exempt pursuant to one (1) or more of the exemptions set forth in paragraph (b) hereunder.

    (b)

    The following transactions are exempt from the requirements of paragraph (a)(1) above:

    (1)

    The division of a lot, tract, parcel or building sites for the purpose of lease or similar contract; provided however, that the division shall not be used as a subterfuge to circumvent the requirements of this chapter.

    (2)

    Small parcels of land transferred or exchanged to or between adjoining property owners upon certification by the department of planning, permits and zoning that such transfer does not create additional lots and does not conflict with the area requirements of the comprehensive zoning ordinance.

    (3)

    Transfer of those portions of a single piece of property physically divided by public highways, levees and/or drainage canals adjacent to levees, upon certification by the department of planning, permits and zoning that such transfers do not conflict with the area requirements of the comprehensive zoning ordinance.
