§ 20-9. Final approval special requirements.

  • (a)

    Before final approval of any subdivision, the owner or developer must submit to the parish government a plan of subdivision or resubdivision for final approval in compliance with the provisions of this chapter, and which shall show compliance with all applicable requirements of this chapter and the plan and agreement of conditional approval.

    (b)

    The final plan, based on the Louisiana Coordinate System of 1983 South Zone as provided in R.S. 50:1 et seq., shall be submitted to the parish government on vellum/film and a digitized format compatible with the requirements of the parish engineering department.

    (c)

    In addition to the other requirements of this chapter, a final plan shall contain and show:

    (1)

    The requirements of section 20-6 of this chapter detailing all of the improvements.

    (2)

    All dimensions, both linear and angular, necessary for locating the boundaries of the subdivision in relation to some section, quarter section or other established corner and line must be shown in order to show the relation of the subdivision boundaries to the section lines, or to other established corners and lines acceptable to the parish government. All dimensions, both linear and angular of the streets, alleys, lots, utility easements or other tracts or areas shall be shown. All dimensions shall be expressed in accordance with state law and regulations.

    (3)

    Location and description of all monuments shall be in accordance with state laws and regulations.

    (4)

    The engineer and/or land surveyor preparing the map or plat shall be licensed and registered in the State of Louisiana at the time of his survey and plan certification.

    (5)

    A note referring to the existence of any restrictive covenants applying to lots in the subdivision printed on the final subdivision map or plan. A duly certified original or copy of the restrictive covenants and the act of dedication, after recordation in the office of the clerk of court and recorder of conveyances and mortgages for Plaquemines Parish, Louisiana, shall be provided to the department of planning, permits and zoning.

    (d)

    An act of dedication of all public rights-of-way (fee and/or servitude) shall be prepared by the owner/developer in the form prescribed by Annex "B", which is not set out herein, but is available for inspection in the office of the council secretary, and signed by the owner and the mortgagee, if any, in the presence of a notary public.

    (e)

    An ordinance form for the approval of the parish council shall be prepared by the owner/developer in the form prescribed by Annex "A".

    (f)

    When all applicable requirements of this chapter have been met and all of the improvements shown on the plan of conditional approval have been constructed in strict compliance with said plan of conditional approval and with the requirements of this chapter, the owner/developer of said subdivision shall request final approval by the parish council.

    (g)

    Upon receipt of request for final approval of a subdivision, the parish president or his designated representatives shall submit a written report to the parish council detailing whether the final plan meets the requirement of this chapter and if construction of all required improvements is completed.

    (h)

    Only after final approval of the plan and subdivision by the parish council will the approved and accepted streets and other accepted public utility facilities be made a part of the street and road system and utilities services of the parish and their maintenance assumed by the parish government; however, the provisions of section 20-13(c), shall control the maintenance and repair of all improvements.
