Article V. MAINTENANCE OF PREMISES IN SANITARY CONDITION |
§ 5-102. Violations.
Any person found violating section 5-101, maintenance of premises, shall be given a warning by an animal control officer or Plaquemines Parish Sheriffs Deputy. Said warning shall give the owner of the premises ten (10) days to correct any and all violations found on the premises. Failure of the owner of the premises to remedy said violation within the ten-day period shall result in the following:

Any person convicted of violating the provisions of section 5-101, maintenance of premises, by court of competent jurisdiction after being duly warned by an animal control officer or Plaquemines Parish Sheriff's Deputy shall be fined not more than two hundred and fifty dollars ($250.00) or imprisoned in the parish prison for not more than thirty (30) days, or both fined and imprisoned at the discretion of the court for a first offense. Any person convicted of violating the provisions of this article by a court of competent jurisdiction on a second and subsequent offense shall be fined not more than three hundred fifty dollars ($350.00) or imprisoned in the Parish Prison for not more than ninety (90) days, or both fined and imprisoned at the discretion of the court.

In addition to being fined and/or imprisoned in the parish prison at the discretion of the court, any person convicted of violating the provisions of section 5-101, maintenance of premises, by a court of competent jurisdiction on a first or subsequent offense, shall be ordered by the court under penalty of contempt of court to clean up said property and restore it to a sanitary condition by removing any and all violations of said article. The Plaquemines Parish Health Department shall notify the judge that the property has been restored to a sanitary condition.
