§ 7-4. Assistance for repair of hurricane damaged driveways.

(a)

The parishy council hereby creates the Hurricane Katrina/Hurricane Rita Disaster Recovery Plan to allow Plaquemines Parish residents to put in claims for the repair of private driveways.

(b)

The plan shall provide that the following criteria must be met for a parish resident to put in a claim for the repair of private driveways as follows:

(1)

The claimant must be a Plaquemines Parish resident.

(2)

The parish resident must have been a resident of Plaquemines Parish prior to August 29, 2005.

(3)

The parish resident must have suffered loss to their private driveway as a direct result from Hurricane Katrina and Hurricane Rita.

(4)

The parish resident has not been reimbursed for said losses from any insurance source.

(5)

The parish resident must meet poverty guidelines as established by the Plaquemines Parish Community Action Agency.

(6)

The parish resident must be a land owner in Plaquemines Parish and over the age of eighteen (18) years old.

(7)

The parish resident shows a financial hardship which places them in a category of poor and needy.

(8)

The Hurricane Katrina/Hurricane Rita Plan shall be administered by the council.

(9)

The Hurricane Katrina/Hurricane Rita Plan shall be funded directly through monies appropriated by the Plaquemines Parish Council or any private donations from any outside Agency.

(10)

The Hurricane Katrina/Hurricane Rita Plan shall allocate said resources for the purchasing of materials to repair private driveways.

(11)

The Hurricane Katrina/Hurricane Rita Plan shall provide assistance through the plan to the parish residents who quality on a first come first serve basis regardless of age, color or religious background in accordance with Title VII of the United States Code preventing discrimination.

(12)

The Hurricane Katrina/Hurricane Rita Plan shall be limited to the resources contained in such plan as financed by the parish council and any donations from any outside agencies and shall not provide any right to any parish resident to receive any assistance from said plan.

(13)

The Hurricane Katrina/Hurricane Rita Pan shall be limited to only the resources contained by said plan and shall last while supplies last.

(14)

The Hurricane Katrina/Hurricane Rita Plan shall be under the review and authority of the parish council.
