Division 1. GENERALLY |
§ 9-24. Conflict with public and private provisions.
(a)
This article is not intended to interfere with, abrogate or annul any other ordinance, statute, rule or regulation, or other provisions of law. Where any provision of this article imposes restrictions different from those imposed by any other provision of this article or by any other ordinance, rule or regulation, or provision of law, whichever provisions are more restrictive or impose higher standards shall control.
(b)
This article is not intended to abrogate any easement, covenant, or any other private agreement or restriction provided that where the provisions of this article are more restrictive or impose higher standards than such easement, covenant, or other private agreement or restriction, the requirements of this article shall govern. Where the provisions of an easement, covenant or other private agreement or restriction impose higher standards, or duties and obligations more restrictive than the requirements of this article or the determination of the parish in the enforcement of these regulations, and such private provisions are not inconsistent with the article or determinations thereunder, then such private provisions shall be operative and supplemental to the provisions of this article and determination made thereunder.
