    ORDINANCE NO. 433

    The following ordinance was offered by Commissioner Kirby who moved its adoption:

    An Ordinance Adopting and Enacting a Code of Ordinances Entitled "Code of Ordinances, Plaquemines Parish Council;" Establishing the Same; Providing for the Repeal of Certain Ordinances Not Included Therein, Except as Herein Expressly Provided; Providing for the Manner of Amending Such Code; and Providing When Said Code Shall Become Effective.

    BE IT ORDAINED BY THE PLAQUEMINES PARISH COMMISSION COUNCIL:

    Section 1. The Code of Ordinances consisting of Chapters 1 through 22, inclusive, is hereby adopted and enacted as the "Code of Ordinances, Plaquemines Parish Council," and shall be treated and considered as a new and original comprehensive ordinance which shall supersede all other general and permanent ordinances passed by the Commission Council on or before August 31, 1977, except such as by reference thereto are expressly saved from repeal or continued in force and effect for any purpose.

    Section 2. All provisions of such Code shall be in force and effect from and after June 1, 1983, in accordance with Section 7, hereof, and all ordinances of a general and permanent nature of Plaquemines Parish, enacted on final passage on or before August 31, 1977, and not in such Code or recognized and continued in force by reference therein are hereby repealed from and after the effective date of such Code, except as herein provided.

    Section 3. The repeal provided for in Section 2 hereof shall not affect any of the following:

    (1)

    Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of such Code.

    (2)

    Any ordinance promising or guaranteeing the payment of money for the Parish, or authorizing the issuance of any bonds of the Parish or any evidence of the Parish's indebtedness or any contract or obligations assumed by the Parish.

    (3)

    Administrative ordinances of the Commission Council not in conflict or inconsistent with the provisions of such Code.

    (4)

    Any ordinance authorizing the signing of a contract or any ordinance which constitutes a contract.

    (5)

    Any ordinance creating or relating to special districts or advisory boards.

    (6)

    Any ordinance prescribing the number, classification, or compensation of parish officers or employees or relating to employee pensions or insurance or to salary deductions in connection therewith, which is not inconsistent with the provisions of this Code.

    (7)

    Any right or franchise granted by the Commission Council.

    (8)

    Any ordinance relating to wards, precincts or polling places.

    (9)

    Any ordinance which proposes an amendment to the Charter for Local Self-Government for Plaquemines Parish, Louisiana.

    (10)

    Any ordinance appropriating, transferring or authorizing the expenditure of funds.

    (11)

    Any ordinance dedicating, naming, establishing, locating, relocating, opening, widening, closing or vacating any street or public way in the Parish.

    (12)

    Any ordinance relating to zoning or subdivisions.

    (13)

    Any ordinance prescribing traffic regulations for specific areas of the Parish, including, but not limited to, ordinances setting speed limits and declaring certain roads or streets to be open to traffic moving only in one direction.

    (14)

    Any portion of Ordinance Number 38, adopted on March 12, 1964, not contained in such Code.

    (15)

    Ordinance Number 68 adopted on January 26, 1967.

    (16)

    Ordinance Number 69, adopted on January 26, 1967.

    (17)

    Any ordinance effective for only a limited period of time.

    (18)

    Any ordinance adopted after August 31, 1977.

    (19)

    Any resolution not contained in such Code.

    (20)

    All actions taken by the Plaquemines Parish Police Jury.

    Such repeal shall not be construed to review any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance.

    Section 4. Any and all additions or amendments to such Code when passed in such form as to indicate the intention of the Commission Council to make the same a part thereof, shall be deemed to be incorporated in such Code so that reference to the "Code of Ordinances, Plaquemines Parish Council," shall be understood and intended to include such additions and amendments.

    Section 5. Three (3) copies of such Code shall be kept on file in the office of the Secretary of the Commission Council, preserved in looseleaf form. It shall be the express duty of such secretary or someone authorized by that officer to insert in their designated places all amendments or ordinances which indicate the intention of the Commission Council to make the same a part of such Code when the same have been printed or reprinted in page form, and to extract from such Code all provisions which may from time to time be repealed by the Commission Council. This copy of such Code shall be available for all persons desiring to examine the same and shall be considered the official "Code of Ordinances, Plaquemines Parish Council."

    Section 6. All ordinances or parts of ordinances of a general and permanent nature not saved from repeal or in conflict herewith or with the Code adopted hereby are hereby repealed.

    Section 7. This ordinance shall be in full force and effect from and after June 1, 1983.

    Section 8. That this ordinance shall be printed in looseleaf form by order of the Commission Council.

    Commissioner Petrovich seconded the motion to adopt the Ordinance.

    The foregoing Ordinance having been submitted to a vote, the vote thereon was as follows:

    YEAS: Commissioners Albert J. Beshel, Billy D. Johnston, Harold D. Gautreaux, Sullivan J. Vullo, Michael E. Kirby, Germaine B. Curley, Luke A. Petrovich and Ernest Johnson.

    NAYS: None

    ABSENT: Stuart J. Guey

    PRESENT BUT NOT VOTING: None

    And this Ordinance was declared adopted on this 4th day of May, 1983.
