§ 17-8. Misdemeanor vandalism.

  • (a)

    Definition. "Misdemeanor vandalism" is the knowing vandalizing, defacing or otherwise damaging of any of the following:

    (1)

    Any church, synagogue or other building, structure or place used for religious worship or other religious purpose;

    (2)

    Any cemetery, mortuary or other facility used for the purpose of burial or memorializing the dead;

    (3)

    Any school, educational facility or community center;

    (4)

    The grounds adjacent to and owned or rented by any institution, facility, building, structure, or place described in paragraph (1), (2) or (3) above;

    (5)

    Any personal property contained in any institution, facility, building, structure or place described in paragraph (1), (2) or (3) above;

    (6)

    Any building, and the contents thereof, owned or leased by the Plaquemines Parish Government;

    (7)

    Any floodwall, floodgate, navigational lock, vehicular or pedestrian bridge or drainage pumping station owned or operated by the Plaquemines Parish Government;

    where the damage for each separate act amounts to not more than five hundred dollars ($500.00).

    (b)

    Penalty. Whoever commits the crime of misdemeanor vandalism shall be fined not more than five hundred dollars ($500.00) or imprisoned for not more than four (4) months in the parish jail or subject to not more than one hundred twenty (120) community service hours within a six-month period to repair the damage or to remove the vandalizing or defacing injury to the property, or a combination thereof, at the discretion of the court.
