§ 20-7. Subdivision drainage and funds.

  • (a)

    No land may be subdivided or developed under the provisions of this chapter unless it is located within a publicly owned and operated drainage district; or within a privately owned drainage system which meets the following standards:

    (1)

    The elevation, stability and other design standards for hurricane protection levees shall meet the criteria established by the U. S. Army Corps of Engineers, the Louisiana Department of Transportation and Development (DOTD) and the parish government;

    (2)

    Pump drainage facilities constructed in accordance with capacity and design criteria established and approved by the Louisiana Department of Transportation and Development (DOTD) and the parish government including but not limited to that certain hydrologic analysis report pertaining to appropriate canal sizes to handle 25-year rainfall events on the west bank of the Mississippi River, Plaquemines Parish, Louisiana, prepared by Prescott Follett & Associates, Inc., New Orleans, Louisiana, dated July 8, 1997, a copy of which is on file in the permit offices of the parish;

    (3)

    Funds for the maintenance and operation of the levees and pumping facilities shall be provided by the owner of the private drainage system and shall be funded in such a manner as to insure perpetual maintenance and operation. Proposals for such funding and operation must be approved by the parish government.

    (b)

    The provisions of Section 20-7(a) above shall not apply to: (1) Camp sites and subdivisions along waterways outside an established or proposed drainage district and (2) Commercial and industrial developments in the flood plan district, as that term is defined in the comprehensive zoning ordinance; provided, however, that in all such cases set forth in (1) and (2) above, all improvements constructed shall comply with all other applicable federal, state and local rules, regulations and laws.
