Chapter 17. OFFENSES—MISCELLANEOUS |
Article IV. HAWKERS, PEDDLERS, SOLICITORS, TRANSIENT AND ITINERANT MERCHANTS |
§ 17-53. Exclusions.
[The following persons are excluded from the prohibition set out in section 17-52:]
(1)
To any person who if prohibited from entering upon private property under this article would be deprived of a constitutional right under the U.S. Constitution.
(2)
(a)
Any licensed person who sells or solicits orders from licensed retail merchants, either on private or public property, including highways located in the parish.
(b)
The word "license" or "licensed" shall be deemed to mean the possession of any occupational and health permit required of commercial dealers, including all occupational and health permits required of dealers in food and/or seafood and those persons transferring said food items in the flow of commerce.
(c)
The word "highway" or "highways" shall be that definition for "highway" as found at R.S. 32:1.
(3)
Any duly authorized representatives of Boy Scouts, Girl Scouts and other bonafide civic nonprofit organizations domiciled in the parish upon first having received approval of the council.
